What is Contentious Probate?

It can be a difficult time when a loved one passes away. The last thing anyone wants is a dispute over their loved one’s estate. However, sometimes disputes are inevitable. This is known as Contentious Probate.

Contentious Probate can arise for several reasons, Such as:

  • Arguments over the validity of the will – was it made whilst the deceased lacked capacity or, were they unduly influenced?
  • Maybe you have been left out of the will and should have been included.
  • You may have concerns over whether the deceased properly understood and approved the will, maybe you believe it has been forged, or there was a clerical error.
  • There may be no dispute over the will’s validity, but you are concerned with how it is being dealt with and administered.
