In 2007 Butterworths Solicitors were asked by a long-standing client, Mr Lancelot William Thwaytes (Bill), to assist in a potential claim for professional negligence against Sotheby’s.

The claim arose out of Sotheby’s research into and advice regarding a painting of the “The Cardsharps” by Caravaggio. Initial assistance was given and experts eventually instructed. The case turned into the most high profile piece of art litigation of 2014, putting the spotlight on the field of art litigation/professional negligence. The Judgement developed this area of law significantly and in particular clarified the standard of care and duty owed by leading auction houses to their clients.

The case highlighted the difficulties experienced by potential claimants in this difficult area of law. As a result, Bill is teaming up with Butterworths to put to good use - for the benefit of others who may find themselves in similar situations and are unsure which way to turn - the enormous knowledge and experience he gained in taking his case all the way to trial.
