When going through a divorce or separation, one of the most challenging exercises is agreeing to the terms surrounding childcare. Such as;
– where the children will live
– how much time they’ll spend with each parent
– how you’ll financially support your children
If you and your ex-partner can agree we can help with creating a legally binding agreement.
If you cannot agree, we can guide you through the mediation process and court proceedings if necessary.
If your case does need to go to court, you will be looking to obtain two different types of court order depending on what can be agreed.
One is a ‘child arrangement order’, and this decides;
-where your child lives
-when your child spends time with each parent
-when and what other types of contact take place (phone calls, for example)
The other order is a ‘Specific issue order’, this order looks at how the child is being brought up and decides;
– what school they go to
– if they should have a religious education.
