Truck Price Fixing Claims

In July 2016 the European Commission found that several of the main truck manufacturing companies in Europe had been operating a cartel with a view to fixing the new price of trucks at the factory gates. In consequence five manufacturers were fined a total of £2.9 billion Euros.

Butterworths commercial litigation team are now acting for a number of haulage clients who have been affected by the actions of the cartel.

The cartel operated over a 14 year period between 1997 – 2011. Any haulier purchasing or leasing new trucks during that period may have a claim for significant compensation. Economic research historically shows that where a cartel is found to be in existence the actions of the cartel, on average, influence the pricing of products by as much as 15-20%. With average truck prices at £80,000 damages could amount to as much as £10,000 per truck.
