Our Wills and Probate department offers specialist advice and assistance with the following matters:
We advise on :-
- Wills
- Administration of Estates
- Powers of Attorney
- Court of Protection
- Nursing Home fees
- Inheritance Tax
- Trusts
Wills :-
Everyone should make a Will, as there are real benefits from doing so.
It is important that you seek professional advice to make sure that your Will is legally valid and that it properly meets your needs.
Mistakenly, people often think that you only need a Will if you have lots of money. This is not the case. Your Will can cover many other aspects from the care of young children to your funeral requirements. By making a Will you can ensure that your wishes are followed, and that your loved ones are provided for.
Our Wills and Probate department will provide you with expert advice on how best to provide for your partner, your children and other members of the family. We can also provide advice about minimising liability for inheritance tax and/or nursing home fees where this is relevant to you.
Administration of Estates :-
We are also experts in the administration of estates, and can offer all the support and assistance that you require at what can be an upsetting time.
In particular our services include :-
- Obtaining the Grant of Probate / Letters of Administration
- Administering Estates
- Advising on and preparing Deeds of Variation
Unlike some firms, we do not add any uplift to our fees. We are also happy to assist you in minimising the potential costs by allowing you to do as much of the work or as little of the work as you want to.
Powers of Attorney :-
We regularly assist clients who want to make provisions for someone else to deal with their affairs, either straight away or in the future.
This may be as a result of foreign travel plans, for business purposes, or to avoid the problems that arise in the event of mental incapacity.
Whatever your situation, we can provide advice about the solution that best meets your needs and prepare the necessary documents.
A number of our clients are concerned about the possibility of future incapacity, and request our help in preparing a Lasting Power of Attorney. These are very useful documents that we would encourage all of our clients to consider making.
We can also assist Attorneys wanting to register Enduring or Lasting Powers of Attorney.
Court of Protection :-
We are able to provide advice and assistance to clients attempting to look after a friend or family member's finances where they have lost their capacity to do this themselves.
This can be a difficult situation for all involved. Our advisers will guide you through the process and make it as simple as possible.
Where necessary we can assist you in applying to the Court of Protection for a Deputyship Order, and provide continuing advice and assistance to you in your new role.
Inheritance Tax :-
We are able to provide advice about your inheritance tax liability and possible ways of minimising this.
Lifetime tax planning is incredibly worthwhile, and it is never to soon to start!
Nursing Home Fees :-
An increasing number of people are worried about their potential liability for nursing home fees.
There are various ways of dealing with this issue, but there is no 'one size fits all' solution. At Butterworths we will discuss your individual situation with you in detail and provide you with full advice.
Trusts :-
We are able to assist in the creation of Trusts and also in providing advice to Trustees or beneficiaries of Trusts.
